SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NO. 50-327/93-32 AND 50-328/93-32)

l This refers to the inspection conducted by M. Thomas of this office on

l June 28 - July 2, 1993 and July 12-23, 1993. The inspection included a review

of activities authorized for your Sequoyah facility. At the conclusion of the

l inspection, the findings were discussed with those members of your staff

'

identified in the enclosed report.

l Areas examined during the inspection are identified in the report. Within

i these areas, the inspection consisted of selective examinations of procedures

i and representative records, interviews with personnel, and observation of

i activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice). The violation is of concern because procedures were not

followed when air quality results for the safety related Auxiliary Control Air

System did not meet acceptance criteria. No corrective action program

document was initiated to identify the test deficiency and no actions were

taken to correct the deficiency. The deficiency was not identified as

requiring resolution prior to restart.

! In addition, we are concerned that the backlog review process, which you

implemented to ensure that all backlogged items were identified and reviewed

l against the restart criteria, was not fully effective. Subsequent to the

l

backlog review process, backlogged items were identified during this

inspection (open test deficiencies) and other NRC inspections (Customer Group

testing, preventive maintenance, and relay testing) which had not been

reviewed. We request that your response to this inspection report include a

description of steps that will be taken to verify that other backlogged items

have not been overlooked.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this

Notice, including your proposed corrective actions and-the results of future

inspections, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of

this letter and its enclosures will be placed in the NRC Public Document Room. l

The responses directed by this letter and the enclosed Notice are not subject ,

to the clearance procedures of the Office of Management and Budget as required  :

by the Paperwork Reduction Act of 1980, Pub. L. No.96-511. t
