Dear Commissioners:

8 k / :,F Y This letter is to advise you that the' Unit States Court of Appeals for the Second Circuit, on October 20, 1981, stayed the order of the District Court in New York ordering Nuclear Fuel Services, Inc. to vacate the West Valley Center and yield the'same to DOE.

The District Court order is stayed until argument is heard by the Second Circuit during the week of November 16, 1981.

In light of this stay, we request that the Commission issue a ruling on Nuclear Fuel Services' Request For A Hearing and Mot'on To Postpone The Effectiveness Of License Amendment by November 9, 1981.

See Rule 6(j) cf the Rules of the United States Court of Appeals for the District of Columbia.

We will keep you advised of any further developments in this matter.
