This is the April 1980 discovery report of Houston Lighting and Power Company.

During the month of April, counsel for Houston deposed the following individuals:

Dr. Norman C. Lerner Transcomm, Inc.

Dr. Jordon Taylor Economic witness for the Department of Justice The further deposition of the NRC Staff's engineering expert, Mr. Robert Hartley, Houston's economic expert, Mr.

Abraham Gerber, and Houston's non-testifying engineer, Mr.

Glenn Stagg, all were postponed upon agreement of counsel.

The deposition of PUB's expert engineering witness, Mr.

William R. Mayben, was also postponed upon the agreement of counsel. Houston has reserved the right to redepose Dr.

Lerner at a time when his testimony has taken final form.

On April 23, Houston filed its motion to exclude proffered expert testimony of Carl Stover. Due to settle-ment negotiations between Houston and the Department, on April 28 counsel for Houston orally contacted Board member Sheldon Wolfe to request that the Department's response be postponed until after May 9. This request was confirmed in writing on May 2.

During the month, Houston also informally received or produced documents with the Department, the NRC Staff, and PUB. At this time, however, Houston is awaiting production of additional documents from the NRC's witness, Mr. Hartley.
