REPORT OF TEXAS UTILITIES COMPANIES - FEBRUARY, 1980 Pursuant to the direction of the Atomic Safety and Licensing Board during the Special Prehearing Conference on June 21, 1978 (Tr . 124-125 ) in South Texas, and during the conference in Comanche Peak and [quth Texas on December 5, 1978 (Tr. 79-90), the Texas Utilities Company System ("TU")

submits this report on discovery during the month of February, 1980.

During the month of February, TU participated in the depositions of Messrs. Ammons, Beams, Borchelt, Campbell, Chalker, Fate, Hebb, Howard, McGinnis, Mckelvy, Meyer, Nelson, Newman, Ozymy, Phillips, Robertson, Scarth, Sweatman, Taylor, Turk, Watson, Wilson, and Yarbrough.

On February 5, counsel for TUGCO inspected documents at the Washington, D.C. offices of the Department of Justice. On i

~ February 7, 1980 TUGCO received CSW's " Motion For Extension Of Time Within Which To Respond To The First Set Of Interrogatories And Requests For Production Of Documents From Texas Utilities Generating Company And Motion For Protective Order." On February 11, 1980, TUGCO filed its opposition to the CSW motion and on February 12, 1980 the Licensing Board issued an order extending the time for response by CSW to TUGCO's first set of interrogatories. On February 26 TUGCO received the updated answer of the NRC Staff to TUGCO's first set of interrogatories and request for production of documents.

On February 28, 1980 the Department of Justice and the NRC Staff jointly filed a motion for " Modification Of Board's Order Regarding Protection Of Settlement Discussions And For An Order To Compel Production Of Certain Documents And Testimony".

On the same date the Department of Justice also filed a motion to compel Texas Utilities Generating Company to supplement its response to the Department's first set of interrogatories and requests for production of documents.

During February, TUGCO also forwarded documents to all appropriate parties in response to various requests received from the Department of Justice and the Public Utilities Board of the City of Brownsville, Texas.
