REPORT OF THE DEPARTMENT OF JUSTICE - deril, 1980 Pursuant to the Order, dated June 21, 1978, issued by the Atomic Safety and Licensing Board (" Board"), the Department of Justice (" Department") hereby submits this Report on the pro-gress made in completing discovery during the month of April, 1980.

During the month of April, the Department participated in the deposition, jointly noticed by Houston Lighting & Power Com-pany ("HL&P") and Texas Utilities Generating Company ( TUGCO"),

of the Department's expert economic witness:

l of Documents Subpoenaed from the Files of Midwest Electric Coop-erative". The Department has recently been informed by counsel l

for South West Texas Electric Cooperative and Midwest Electric Cooperative that the documents sought by the aforementioned mo-tions are now being copied for all interested counsel and will soon be available for inspection.

By agreement among counsel, the Department has not yet re-sponded to HL&P's April 23, 1980 Motion relating to the proposed testimony of Carl Stover due to ongoing settlement discussions.

While a limited amount of discovery remains to be completed by all parties, the Department has agreed with counsel from HL&P, TUGCO and the Nuclear Regulatory Commission Staff not to pursue further discovery until present settlement discussions reach an impasse.

Pursuant to the Board's April 10, 1980 Order, the Department utilized the majority of April in settlement discussions and trial preparation. The settlement meetings and discussions in which the Department participted were itemized in the Department's status report filed on May 9, 1980.
