REPORT OF TEXAS UTILITIES COMPANIES - DECEMBER, 1979

- Pursuant to the direction of the Atomic Safety and Licensing Board during the Special Prehearing Conference on June 21, 1978 (Tr. 124-125) in South Texas, and during the conferences in Comanche Peak and South Texas on December 5, 1978 (Tr. 79-90) ,

the Texas Utilities Company System ("TU") submits this report on discovery during the month of December, 1979.

During the month of December, TU participated in the depositions of Messrs. Austin, Berman, Brittain, Campbell, Coffman, Daniels, Gambrell, Heath, Howard, Hughes, Hulsey, Loveless, Skelton, Spense and Wilson. The deposition of Mr. Wilson was not completed and counsel agreed to continue the deposition at a mutually convenient time.

In a pleading filed with the Board on December 10,.1979, TU opposed without success the extension of discovery requested by the Department. .

During December, TU also responded to Central Power &

Light Company's Third Set of Interrogatories and Request for Production of Documents, including therewith copies of certain of the documents requested and also nctified CSW that additional requested documents were available for inspection and copying.

TU requested:a' protective order, which was approved by applicable parties, with respect to certain documents covered by requestu made during the depositions of Messrs. Parks, Hatcher, Tanner and Bradley and called for in response to CP&L's Second Set of Interrogatories. These documents were produced in anticipation of the entry of the protective order and under agreement of applicable parties to be bound by the terms of the protective order even if not entered.

In addition, in an effort to cooperate fully with all parties in the rapid completion of discovery, TU voluntarily provided d'ocuments informally requested during the depositions of Campbell, Daniels, Howard, Skelton and Loveless. TU also made available for inspection other documents informally requested during the deposition of Mr. Taylor and at other depositions previously taken.

The depositions of Messrs. Erwin, Newell, Pennebaker, Stoddard, Wallar and Weathersby, previously noticed by the Department, were cancelled or postponed at the request of the Department. . .

Mr. Scarth, TU's expert engineering witness, was available to be deposed during most of December, but the Department was unable or unwilling to proceed at that time. Mr. Scarth's deposition has been scheduled by agreement for February 13-14, 1980.

TU is continuing to attempt to resolve the disagreement with Brownsville over the terms of a protective order covering certain fuel contracts and related documents. TU is hopeful that it will be able to resolve this problem by mutual agreement.
