REPORT OF THE DEPARTMENT OF JUSTICE - MARCH, 1980 Pursuant to the Order dated June 21, 1978, issued by the Atomic Safety and Licensing Board (" Board"), the Department of Justice (" Department") hereby submits this Report on the progress made in completing discovery during the month of March, 1980.

On March 5, 1980, the Department filed " Department of Justice Response to Motion of Houston Lighting & Power Company to Department of Justice to Provide Interrogatory Answers With

, Respect to the Proposed Expert Testimony of Carl Stover. On March 14, 1980, the Department together with the Staff filed

" Joint Application for Issuance of Subpoenas." On March 26, 1980 the Department and Staff filed: "NRC Staff and the Depart-ment of Justice Joint Response to the Motion of Houston Lighting

& Power Company to Quash Subpoenas of Mr. Glenn Stagg."

On March 7, 1980, the Department appeared before this Board to argue " Joint Motion of the Department of Justice and the Nuclear Regulatory Commission Staf f for Modification of Board's Order Regarding Protection of Settlement Discussions and for an Order to Compel Production of Certain Documents and Testimony", filed on February 28, 1980. On March 12, 1980, HL&P, TUGCO and Central and South West Corporation filed peti-ti;rns with the Atomic Safety and Licensing Appeal Board (" Appeal Board") seeking reversal of the Board's ruling of March 7,1980.

Subsequent to the Appeal Board's March 13, 1980 Order, the Department submitted its responsive Memorandum. Oral argument was heard by the Appeal Board on March 27, 1980 On March 28, 1980, the Appeal Board requested that 1.he parties furnish addi-tional authority on the issue of whether the courts do or should recognize a settlement privilege at the discovery stage. The parties filed briefs pursuant to this Order on April 4,1980.

The Department filed its responsive brief on April 9,1980. On April 15, 1980, the Appeal Board issued an Order continuing the effect of its March 13, 1980 Order staying the Board's March 7, 1980 Order until the parties report on the status of any settle-ment negotiations on May 9,1980. ,
