This is the monthly discovery report of the Public Utilities Board of the City of Brownsville for the month of January, 1980.

During January, Brownsville participated in the deposi-tions of three officers of Central Power & Light Company (CP&L).

The deposition of Merle Borchelt, Chief Engineer of CP&L, was commenced on January 9, 1980.

The deposition of Durwood Chalker, Chairman of the Board and Chief Executive Officer of CP&L, was commenced on January 11, 1980.

Neither deposition was completed in the time provided.

They will be continued on February 18 and 19, 1980, respec tively, in Corpus Christi, Texas.

The deposition of Mr. Aaron Autry, President of CP&L, was conducted on January 10, 1980.

Brownsville furnished to HL&P the contents of a file responsive to its discovery request and apparently not fur-nished previously. In accordance with the request of HL&P counsel, Brownsville is verifying other files for possible additional responsive documents.

At the request of HL&P's counsel, Brownsville expert engineer William R. Mayben is assembling background material relating to his previous testimony in other unrelated dockets.

During the week of January 22, 1980, counsel for Prownsville received preliminary copies of the transcripts of msitions of "essrs. Gawlik, Hastings and Lizka, taken

. Brownsville has not yet received copies of the documents requested after inspection of files at West Tbxas Utilities (Abilene) on December 4, 1979.

Some of the documents requested from Public Service Company of Oklahoma (Tulsa) pursuant to document inspection on December 11, 1980, have been received.

Brownsville has not received a complete copy of the November 29, 1968 memorandum it requested from CP&L in a letter dated December 7, 1979.

No documents have yet been received from Texas Utilities and its subsidiaries pursuant to an inspection of their files that took place in November, 1979.

In accordance with the Board's Order of January 15, 1980, the deposition of Mr. S.

9hillips, Chairman and Chief Executive Officer of Central and South West Corporation will be scheduled during February.

Brownsville also filed on February 1, 1980, a Motion to Compel Deposition of Mr.

R.

W.

Hardy, formerly Chairman and Chief Executive Officer of CP&L.

Two additional potential witnesses, Mr. Ruben Edelstein, former Mayor of Brownsville and former Chairman of the Public Utilities Board, and Mr. Al Cisneros, Director of the Brownsville Navigation District, will be scheduled during February, pursuant to subpoenas issued by HL&P and TUGCO.

The schedule for depositions of Brownsville's expert witnesses is as follows:

Brownsville continues to analyze documents it has received pursuant to its requests and the supplemental requests of others as it receives them.
