This is the monthly report of the Public Utilities Board of the City of Brownsville, Texas ("Brownsville"), concerning its progress toward completion of discovery in the above captioned proceeding.

During December, Brownsville inspected documents at West Texas Utilities (Abilene, Texas) and Public Service Company of Oklahoma (Tulsa, Oklahoma). None of these documents have been received.

Brownsville expects to receive shortly the documents it inspected at the Texas Utilities Companies at the end of November. The matter of TUGCO's proposed modification to the terms of the agreed-upon protective order is still under discussion.

Brownsville has not yet received for review the prelimi-nary copies of the depcsitions of Messrs. Roundtree, Lizka, and Hastings, which were taken on November 12-15, 1979. A copy of Mr. Gawlik's deposition was received today.

Brownsville noticed the deposition of Mr. Durwood Chalker, Chairman of the Board and Chief Executive Office of Central Power and Light Company. Mr. Chalker's deposition, along with depositions of Mr. Merle Borchelt and Mr. Aaron Autry, took place on January 9-11 in Corpus Christi, Texas.

The depositions of Mr. Chalker and Mr. Borchelt were not completed and will resume at a mutually convenient time and place. _

Brownsville filed a motion to compel the deposition of Mr. S. W. Phillips, Jr., Chairman of the Board and Chief Executive Office of Central and South West Corporation opposed this deposition in its Motion to Quash, to which Brownsville filed a response. This matter is now panding before the Licensing Board.

Brownsville also requested from CP&L an affidavit con-cerning the medical condition of Mr. R. W. Hardy, former Chairman of the Board of Central Power & Light. Mr. Hardy's health is the basis of CP5L's request not to seek Mr. Hardy's deposition. A letter was provided to Brownsville last week.

Brownsville furnished a further supplemental response to HL&P's interrogatories on the subject of competition and market analysis.

Brownsville received a request for copies of previous testimony in other proceedings by Mr. William R. Mayben, who may testify on certain engineering matters on behalf of Brownsville.

During the month of December, Dr. John Wilson, Brownsville's economic expert, was deposed on December 21.

That deposition has not yet been concluded, and will con-tinue on February 7, 1980. It also provided Dr. Wilson's work papers as requested by HL&P.

Brownsville continues to analyse the additional docu-ments received from time to time in response to its interro-gatories and the supplemental interrogatories of other parties.
