I am writing to correct a misstatement of fact contained in the April 30, 1980 discovery report for the months of March and April, 1980 filed by counsel for the Public Utilities Board of the City of Brownsville, Texas.

Counsel inaccurately states that Brownsville "was unable to participate in James Bruggeman's deposition because of a misunderstanding between counsel, in that Brownsville was not timely informed that Mr. Bruggeman's deposition had i been moved from March 7 to March 6." On the afternoon of March 6, I called Spiegel and McDiarmid and asked Mr. Poirier whether he intended to attend the deposition of Mr. Bruggeman on the 7th, since I would have made Mr. Bruggeman available on the 7th to accommodate counsel for Brownsville.* Mr. Poirier was, however, unable to tell me whether he could attend Mr. Bruggeman's deposi-tion on the 7th since Mr. Spiegel wanted Mr. Poirier to attend the hearing before the Licensing Board concerning the Staff and Justice Department motion relating to settlement documents. I requested Mr. Poirier to call me

  • Mr. Bruggeman was questioned by counsel for Houston Lighting and Power Company and Texas Utilities Company for an entire day on the 6th.

back if he subsequently learned that he could attend the Bruggeman deposition on the 7th. I did not receive a subsequent call from Mr. Poirier or any other Spiegel and McDiarmid attorney concerning the Bruggeman deposition.

The transcript of proceedings before the Licensing Board on March 7 demonstrates that Mr. Poirier attended those proceedings on that day. At no time did counsel for Brownsville request that the Bruggeman deposition be re-scheduled so that counsel could attend the March 7 pro-ceedings and have the opportunity to question Mr. Bruggeman.

In sum, Brownsville's failure to participate in Mr. Bruggeman's deposition was not due in any way to any

" misunderstanding" between counsel or any failure to inform counsel of any change in the deposition date. Mr. Bruggeman was available on the originally scheduled date and could have been deposed by Brownsville at that time. Failure of Brownsville to der se Mr. Bruggeman is due exclusively to its counsel's independent decision to attend the Licensing Board's hearing on March 7.
