FINAL SIGNIFICANCE DETERMINATION FOR SECURITY-RELATED GREEN FINDINGS AND ASSOCIATED NON-CITED VIOLATIONS; NRC SECURITY BASELINE INSPECTION REPORT NO. 05000305/2008201 FOR KEWAUNEE POWER STATION

Dear Mr. Christian:

The purpose of this letter is to provide you the final results of our significance determination for the preliminary Greater than Green finding identified in the subject inspection report. The inspection finding was assessed using the Physical Protection Significance Determination Process and was preliminarily characterized as more than very low security significance. On September 5, 2008, you were presented with a Preliminary Significance Determination Letter which afforded you the opportunity of participating in a Regulatory Conference to mitigate the finding or provide new information to be considered in reaching the final determination.

During a telephone call on September 24, 2008, Mr. Stephen Scace of your staff requested the opportunity to discuss these issues at a Regulatory Conference that was conducted on October 6, 2008, in Lisle, Illinois, at the Regional Office. During the meeting, your staff described your assessment of the finding, including the root cause, as well as the corrective actions taken.

After considering the information developed during the inspection, and the additional information provided during the Regulatory Conference, the NRC has concluded that two findings of very low security significance (Green) and associated non-cited violations (NCVs) existed.

Enclosure 1 to this letter provides our evaluation of the information you presented during the regulatory conference, while Enclosure 2 provides the details of the final significance determination, including discussion of the NCVs.

Enclosure contains Safeguards Information. Upon removal, this letter is decontrolled. Because of their very low security significance, and because the issues were entered into your corrective action program, the NRC is treating the violations as Non-Cited Violations (NCVs),

consistent with Section VI.A.1 of the NRC Enforcement Policy. If you contest the subject or severity of these NCVs, you should provide a response within 30 days of the date of this letter, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001, with a copy to the Regional Administrator, U.S.

Nuclear Regulatory Commission - Region III, 2443 Warrenville Road, Suite 210, Lisle, IL 60532-4352; the Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001; and the Resident Inspector Office at the Kewaunee Power Station.

Please keep us informed of the status of your corrective actions for the enclosed NCVs.

Knowing the status of the corrective actions will help us make a determination for a follow-up visit to evaluate effectiveness.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System (PARS) component of NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related concerns contained in the enclosures, and in accordance with 10 CFR 2.390, a copy of this letters enclosures will not be available for public inspection.

Because this issue involves security-related information, your response, should you choose to provide one, will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS). If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21. Otherwise, mark your entire response Security-Related Information -

Withhold Under 10 CFR 2.390 and follow the instructions for withholding in 10 CFR 2.390(b)(1).

In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
