Thisagency'sareasofconcernarefloodcontrolhazardpotentials,,permit requirements underSection404oftheCleanWaterAct,andotherdirectandindirectimpactsonCorpsofEngineers existingand/orproposedprojects.

Inaccordance withtheseresponsibilities, ourofficehasthefollowing comments:

a.Theproposeddamistobeconstructed inwatersoftheUnitedStatesandis,,therefore, subjecttotheregulatory authority ofthisoffice.However,sincetheproposeddamistobeconstructed abovetheheadwaters ofPondHillCreek,theworkisauthorized undertheprovisions ofaDepartment oftheArmyNationwide Permit.Theattached'sheetdescribes theconditions whichmustbesatisfied forthepurposesofSection404oftheCleanWaterAct,andtheManagement Practices whichshouldbefollowed, tothemaximumextentpracticable, inthedischarges ofdredgedorfillmaterialtominimizetheadverseeffectsofthesedischarges ontheaquaticenvironment.

Theproposedintakestructure istoextendapproximately 30metersintotheSusquehanna River,anavigable wateroftheUnitedStates,therefore, anindividual Department oftheArmypermitfortheintakewouldberequiredinaccordance withSection10oftheRiverandHarborAct.b.Asnotedin4.4.2.3,Hydrologic DesignonDam,page4-11,theproposedspillwaywouldbeinadequate forpassingthePMFusingNRCcriteria.

Thus,apotential floodhazardwouldexistfromfailureofthedamduetoovertopping.

Thedocumentshouldaddressthisfloodhazard.
