O APPENDIX A NOTICE OF VIOLATION Duke Power Company License Nos. CPPR-117 Catawba CPPR-118 Based on the NRC inspection August 25-29, 1980, certain of your activities were apparently not conducted in full compliance with NRC requirements as indicated below. These items have aeen categorized as described in correspondence to you dated December 31, 1974.

As required by 10 CFR 50, Appendix B, Criterion VII, and as implemented by Duke Power Company Topical Report Section 17.1.7 which states:

Duke's quality assurance program requires the control of safety-related items or services purchased from a vendor, subvendor or consultant. Table 17.0-1 of Duke Power Company Topical Report commits to the requirements of Regulatory Guide 1.123, Revision 1, which endorses ANSI N45.2.13-1976. Paragraph 10.1 of ANSI N45.2.13 requires that the supplier verify that the item or service being furnished complies with the procurement requirements, prior to offering the item or service for acceptance.

Contrary to the above, diesel generator battery racks IDGBA, IDGBB, 2DGBA and 2DGBB did not meet the seismic requirements of the procurement documents.

The battery racks had been receipt inspected, accepted and installed by the licensee.

This is an infraction.
