RELAXATION OF CONFIRMATORY ORDER MODIFYING LICENSE FOR THE CLINTON POWER STATION, UNIT 1 (TAC NO. M85535)

Dear Mr. MacFarland:

By letter dated December 7,1998, you requested relaxation of the Confirmatory Order Modifying License (Order) issued June 26,1998, for the Illinois Power (IP) Clinton Power Station (CPS). The Order confirmed IP's commitment to complete implementation of Thermo-Lag 330-1 fire barrier corrective actions by December 31,1998. You proposed that the specific completion date of December 31,1998, be changed to a non-specific completion date of prior ,

to startup from the current shutdown.

The reasons you gave for requesting the change include: (1) IP has continued to implement Thermo-Lag 330-1 fire barrier corrective actions since the issuance of the Order, (2) significant progress has been made on the corrective actions during the extended outage, (3) considerable engineering resources are required to implement the corrective actions, (4) IP resources are being used for other CPS recovery activities, and (5) the request is consistent with your intent to complete the corrective actions during the current outage, while accounting for slippage of the projected startup date that has occurred since issuance of the Order.

Based on the information provided, I find that the completion date for implementation of Thermo-Lag 330-1 fire barrier corrective actions at CPS may be changed from December 31, 1998, to prior to startup from the current shutdown.
