Dear Mr. Collins:

The purpose of this letter is to request relaxation of a provision contained in the Confirmatory Order Modifying License for the Clinton Power Station (CPS), Unit I regarding implementation of Thermo-Lag 330-1 fire barrier corrective actions. By letter dated June 26,1998, the subject Confirmatory Order was issued which ordered Blinois Power (IP) to complete Thermo-Lag 330-1 fue banier corrective actions at CPS by l December 31,1998. The June 26,1998, letter noted that the Director, Office ofNuclear Reactor Regulation, may relax or rescind, in writing, any provisions of the subject Confirmatory Order upon a showing by the Licensee of good cause.

Blinois Power has continued efforts to implement Thermo-Lag 330-1 fire barrier corrective actions since the issuance of the subject Confirmatory Order, and has made significant progress during the current, extended outage / recovery period at CPS. These efforts and progress were recognized during the recent Nuclear Regulatory Commission (NRC) inspection of the CPS Fire Protection Program. However, based on the considerable engineering resources required to implement the Thermo-Lag 330-1 corrective actions and the utilization ofIP resources for other CPS recovery activities, IP is requesting i

that the provision of the Confirmatory Order for completing the Thermo-Lag 330-1 fire barrier corrective actions be relaxed to require completion prior to startup of the Clinton Power Station. This request is consistent with the intent to complete the corrective actions during the current outage (i.e., while the plant is in a shutdown condition) while accounting i for slippage of the projected startup date that has occurred since issuance of the Confirmatory Order.
