Gentlemen:

In a letter dated August 21, 1989, the NRC informed Carolina Power & Light Company (CP&L) of their conclusion that the "as-built" alternate rod injection (ARI) system at Brunswick is not in agreement with the ATWS Rule Guidance.

Specifically, the ARI system is not powered independently from the reactor trip system (RTS). The Company was requested to advise the Staff, within 15 days, of whether the guidance of the rule will be met for this system.

Carolina Power & Light Company is reviewing the existing design of the Brunswick ARI system against the requirements of ATWS Rule, the ATWS Rule Guidance, and the Company's previous commitment. The proposed resolution will either be consistent with the Company's earlier commitment or an alternative, acceptable to the Staff, which meets the requirements of the ATWS Rule.

A plan and schedule for resolution of this issue will be submitted by October 23, 1989.
