On January 23, 1990, a conference call was held between members of the NRC and Carolina Power & Light Company. During this call, the NRC requested that CP&L submit a letter which (1) identified those Technical Specification Interpretations (TSIs) which result from the inability to perform the requirement due to the physical configuration of the plant, (2) provided an analysis of the safety significance of each TSI identified, (3) establishes a schedule for submitting the associated license amendment request or additional information, and (4) requested a waiver of compliance for these TSIs until the license amendment process can be completed. On February 2,1990 Carolina Power & Light Company requested a waiver of. compliance (NLS 90 026) for six Technical Specifications (five originally identified by the NRC and one additional issue included by CP&L). The NRC granted the requested waiver of compliance by letter dated February 14, 1990.

Since the Company's February 2, 1990 request, CP&L has submitted two license amendment requests and additional information concerning a pending license amendment request to complete the actions required of the Company for the five NRC identified issues. The remaining issue deals with Technical Specification Section 3/4.8.1 regarding the operability requirements for offsite power sources associated with a unit in Operational Condition 4 or 5. The existing requirements are too restrictive in requiring two offsite power sources to a shutdown unit if the other unit is in Operational Condition 1,.2, or 3. This unnecessarily limits maintenance on either the Unit Auxiliary Transformer (UAT) or the Startup Auxiliary Transformer (SAT) whilt; a unit is shutdown to a 72 hour8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> period.

In the February 2, 1990 submittal, CP&L stated that we intended to submit a license amendment request to resolve the Technical Specification Section 3/4.8.1 issue by April 27, 1990. Preparation of the amendment request hss taken longer the.n expected. In order to allow adequate time to prepare justification and review the proposed changes, submittal of the amendment request will be made by May 31, 1990. There is no safety concern due to this delay because this is only an issue when a unit is in Operational Condition 4' d
