l By letter dated January 25,1999 (Serial: BSEP 98-0241), Carolina Power & Light (CP&L)

Compaay requested a change to the Quality Assurance Program description for the Brunswick Steam Electric Plant (BSEP), Unit Nos. I and 2. The proposed change would revise the educational qualification requirements for personnel performing the Independent Safety Reviewer (ISR) function and allow greater flexibility for the manager of the ISR function.

At the time the request was submitted, the proposed change was considered to be a reduction in comminnents that required NRC review and approval prior to implementation, in accordance with 10 CFR 50.54( )(3). However, on February 23,1999, the NRC published a Direct Final Rule notice in the Federal Register amending its regulations to permit power reactor licensees to make certain Quality Assurance Program changes without obtaining NRC approval of the f

changes in advance. As confirmed in a telephone conversation on April 28,1999, with f p Mr. Harry S. Tovmassian of the NRC Office of Nuclear Reactor Regulation, the Direct Final Rule became effective April 26,1999. g As a result of the new Direct Final Rule, CP&L has reviewed the request submitted on January 25,1999, and determined the request involves the use of a quality assurance standard approved by the NRC which is more recent than the quality assurance standard in CP&L's current Quality Assurance Program at the time of the change (i.e.,10 CFR 50.54(a)(3)(i)). The use of the more recent standard has been previously approved by an NRC Safety Evaluation, and the bases of the NRC approval are applicable to BSEP. As such, the change falls within the scope of the changes implemented by the Direct Final Rule and prior NRC approval of the change is no longer necessary. Therefore, CP&L respectfully withdraws the request for approval of the proposed Quality Assurance Program change that was submitted by letter dated January 25, 1999.
