NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50 295; 50-304 Zion Nuclear Generating Station License Nos DPR 39;DPR 48 During an NRC inspection conducted from December 17,1997, through February 2,1998, one violation of NRC requirements was identified. In accordance with the

  • General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

Technical Specification 6.2.1.a requires that written procedures be prepared, implemented, and maintained for procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2 February 1978, 1 Appendix A of Regulatory Guide 1.33, Revision 2. February 1978, specifies equipment control, e.g., locking and tagging, as an example of an administrative procedure.

Zion Administrative Procedure 300 06, *Out of Service Process," Revision 17, Appendix B.

" Lifting Out of Service Techniques," specifies, in part, that equipment be returned to service in accordance with the applicable system operating instruction, ,

System Operating instruction 10E," Aligning Auxiliary Feedwater System For Split Header Lineup," Revision 9, specifies the positions of the 2B auxiliary feedwater pump discharge isolation valve,2FWOO38, and the 2B auxiliary feedwater pump discharge stop valve,2FWOO42, as locked closed.

Contrary to the above, on January 7,1998, the licensee retumed to service both valves 2FWOO38 and 2FWOO42 in the locked open position instead of the locked closed position specified in applicable System Operating Instruction 10E This is a Severity LevelIV violation (Supplement I). Pursuant to the provisions of 10 CFR 2.201, Commonwealth Edison Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C,20555, with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:- (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. if an adequate reply is not received within the time specified in the Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
