k' APPENDIX A NOTICE OF VIOLATION New York Power Authority Docket No. 50-3?3 James A. FitzPatrick Nuclear Power Plant License No. DPR-59 As a result of the inspection conducted on August 8, 1988 to October 5, 1988, and in accordance with FRC Enforcement Policy (10 CFR Part 2, Appendix C) the following violation was identified:

A. Technical Specifications 6.8(a) requires that written procedures and administrative policies be imr.h,mented that meet or exceed the requirements and recommendations.of Section 5 "Facility- Administrative Policies and Procedures" of ANSI 18.7 - 1972 and Appendix A of Regulatory Guide 1.33, November 1972.

1. Regulatory Guide 1.33, lists core alterations as a typical safety-related activity which should be covered by written procedures.

Appendix A, Section B.10 of Reactor Analyst Procedure (RAP) 7.1.24, Spiral Offload /Onload Refueling, Revision 8, dated September 30, 1988, restoration Section 7.7.3 has a caution which states "Do not attempt to precharge the nitrogen side of a discharged accumulator before the scram valves are closed. Nitrogen precharging may cause inadvertent insertion of the control rod."

Contrary to the above, on October 4, 1988, a nitrogen precharge of a discharged accumulator was performed with the scram valves open and caused an inadvertent insertion of the associated control rod (14-15).

2. Appendix A, Section 0.2 of Regulatory Guide 1.33, lists the control rod drive system as a system for which instructions should be pre-pared for filling, venting, startup, and changing modes of operation.

Operating Procedure, F-0P-25, Control Rod Drive Hydraulic System, Revision No. 31, dated August 31, 1988, Section G.2.a requires verifying the water side of the accumulator is discharged prior to precharging the gas side.  !

Contrary to the above, on October 4, 1988, the water side of the hydraulic control unit (HCU) 14-15 was not discharged prior to pre-charging the gas side.  ;

3. ANSI 18.7-1972, Section 5.1.6, Maintenance, states maintenance that I can affect the performance of safety-related equipment shall be pri parly performed in accordance with written procedures or drawings, appropriate to the circumstances, which conform to applicable codes.

10 CFR 50, Appendix B, Criterion VI, further requires that measures shall assure that documants, including changes, are reviewed for ade-quacy and approved for release by authorized personnel and are d u-i tributed to and used at the location where the prescribed activity is performed.

Appendix A 2 j Work Activity-Control Procedure 10.1.9, Rev. 2, dated September 14, 1988 requires that the plant staff shall use the drawings on the controlled print sticks or aperture card files. If a copy of a controlled drawing is required these can be obtained using the controlled drawing aperture cards.

Contrary to the above, on September 27, 1988, controlled drawings ,

were nct used while performing pre-checks for the pre-operational test of the Alternate Rod Insertion Modification F1-85-053. Alter-nate Rod Insertion Wiring System drawings whicn were not made from a controlled print in the plant's drawing control system, and not approved for release by the Document Control Supervisor were being used.

These violations collectively have been categorized as a Severity Level IV

. Violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, New York Power Authority is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation  ;

in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
