-O APPENDIX A NOTICE OF VIOLATION Power Authority of the State of New York Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. DPR-59 P. O. Box 41 Lycoming, New York 13093 As a result of the inspection conducted on October 11, 1988 by a representative of the South Carolina Department of Health and Environmental Control, of a shipment of licensed material sent from your facility on or about September 24, 1988, and in accordance with the NRC Enforcement Policy, 10 CFR 2, Appendix C, the following violation was identified:

10 CFR 30.41(c) states in part that "Before transferring byproduct material to a specific licensee of...an Agreement State...the licensee transferring the material shall verify that the transferee's license authorizes the receipt of the type, form and quantity of byproduct material to be transferred".
