APPENDIX A NOTICE OF VIOLATION 4

Power Authority of the State of New York Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No.DPR-59 As a result of the inspection conducted on December 1, 1985 to January 17, 1986, and in accordance with the General Statement of Policy and Procedure for Enforcement Actions (Enforcement Policy),10 CFR 2, Appendix C (1985), the following violation was identified:

10 CFR 50.72(b)(2)(ii) requires that the licensee notify the NRC Operations Center, via the Emergency Notification System, as soon as practical and in all cases within four hours of any event that:

1. Results in automatic actuation of any Engineered Safety Feature.

Contrary to the above, the licensee did not notify the NRC Operations Center of automatic isolations of the High Pressure Coolant Injection System which occurred on December 13, 1985, and twice on December 16, 1985.

2. Alone could have prevented the fulfillment of the safety function of structures or systems needed to mitigate the consequences of an accident.

Contrary to the above, the licensee did not notify the NRC Oper-ations Center when the High Pressure Coolant Injection System was declared inoperable as a result of the failure of the steam supply isolation valve on October 29, 1985.

This is a Severity Level V Violation. (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, the Power Authority of the State of New York is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. l Where good cause is shown, consideration will be given to extending this response time.
