ENCLOSURE 1 NOTICE OF VIOLATION New York Power Authority Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. DPR-59 During an NRC inspection condu:ted from December 22,1997 to February 22,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600,the violation is listed below:

Technical Specification (TS) Appendix B, Section 3.8, Standby Gas Treatment System (SBGTS) discusses the applicability of the SBGTS instrumentation and states the objective is "to assure that the SBGTS is actuated with the proper signal." The limiting conditions for operation are stated in TS Table 3.10-1, Radiation Monitoring Systems That initiate and/or Isolate Systems. Table 3.10-1 requires at least one channel of the reactor building area exhaust monitors to be operable with the applicable notes stating "Whenever the systems are required to be operable, there shall be one operable or tripped instrument channel per system.  !

From and after the time it is found that this cannot be met, the indicated action shall be taken." The indicated action is to isolate secondary containment and start the SBGTS.

Contrary to the above, on January 28,1998, from approximately 10:00 a m. Until 4:00 p.m., the licensee failed to isolate secondary containment and start the SBGTS when the only operable channel of the reactor building radiation monitor system below the refueling floor was made inoperable by the plant operators by taking the "B" instrument to the down scale condition while the "A" train of the SBGTS was removed from service.

This is a Severity level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, New York Power Authority is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector, within 30 days of receipt of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation or severity level, (2) the corrective neps that have been taken and the results achieved, (3) the corrective steps that will t 3 taken to avoid further violations, and (4) the date when full co.npliance will be achieved. Your response may reference or include previous

. docketed correspondence, if the correspondence adequately addresses the required response. Where good cause is shown, consideration will be given to extending the

- response time.
