l ENCLOSURE 1 NOTICE OF VIOLATION New York Power Authority Docket No. 50 333 James A. FitzPatrick Nuclear Power Plant License ilo. DPR 59 During an NRC inspection conducted from August 31 to October 26,1997, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," (Enforcement Policy), NUREG 1600, the violation is listed below:

Technical specification 6.8.A.1 requires that written procedures and administrative l

policies shall be established, implemented, and maintained that meet or exceed the requirements and recommendations of Section 5 of American National Standards Institute (ANSI) 18.71972," Facility Administrative Policies and Procedures.

"Section 5 of ANSI 18.7-1972 requires, in part, that f acility rules and instructions shall be established pertaining to maintenance that can affect the performance of safety related equipment and that maintenance that can affect the performance of safety-related equipment shall be properly pre planned and performed in accordance with written procedures which conform to applicable codes, standards, specifications and criteria. Administrative Procedure (AP) - 02.01, Procedure Writing Manual, provides guidance to ensure that procedures are technically correct.

Contrary to the above, on Auguet.?2,1997 maintenance that affects the performance of safety reinted equipment was not properly pre planc,ed and performed iri that a maintenance procedure was incorrect and resulted in using the wrong oil for the "A" residual heat removal system keep fill pump.

This is a Severity Level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, New York Power Authority is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region I, within 30 days of receipt of the letter transmitting this Notice of Violation (Notice). This rcply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reasco for the violation, or, if contested, the basis for disputing the violation, (2) the corrective stept that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence,if the correspondence adequately addresses the required response. Where good cause is shown, consideration will be given to extending the response time.
