Power Authority of the State 3 of New York APPENDIX A NOTICE OF VIOLATION Power Authority of the State of New York Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. OPR-59 As a result of the inspection conducted on January 18, 1986 to March 10, 1986, and in accordance with General Statement of Policy and Procedure for Enforce-ment Actions (Enforcement Policy),10 CFR 2, Appendix C (1985), the following violation was identified:

Technical Specification 4.0.B requires that surveillance tests be performed within the specified time interval with an allowable variation of +/- 25% of the surveillance interval.

1. Technical Specification 4.1.A requires a functional test of the Average Power Range Monitor (APRM) Flow Bias Scram circuitry be performed once per month.

Contrary to the above, Surveillance Test Procedure, F-ST-5Q, APRM Flow Bias Functional Test, Revision 8, dated April 6, 1983 was not performed from June 9, 1985 to March 2, 1986, missing the surveillance requirement 8 times.

2. Technical Specification 4.12.A.1.1 requires verification that the spe-cific gravity for the Diesel Fire Pump starting 24 volt battery is approp-riate once per quarter.

Contrary to the above, Maintenance Procedure MP 76.10, Diesel Fire Pump Battery Specific Gravity Surveillance Test, Revision 0, dated February 20, 1985 was not performed from October 22, 1985 to March 3, 1986, missing the surveillance requirement once.

This is a Severity Level IV Violation. (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, the Power Authority of the State of New York is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
