CLOSE0VT OF VALVE TAMPERING ALLEGATION AT BIG ROCK POINT (50-155) (AMS NO. Rlll-87-A-0042)

On April 9, 1987, Region 111 received an allegation that a valve in the liquid poison control system at the Big Rock Point Plant had been tampered with by backing off the nut on the packing gland. Region Ill informed the NRC:HQ Information Assessment Team, the Federal Bureau of Investigation and the NRC's Office of Investigations. Region 111 clso conducted an inspection of the technical aspects of the allegation (see Inspection Reports No. 50-155/87010; No. 50-87012).

By memorandum, dated October 15, 1987 (Enclosure 1), the Information Assessment Team informed Region III that the Federal Bureau of Investigation declined to investigate the valve tampering issue. Subsequently, the Office of Investigations opened Investigation No. Q3-87-020. However, on January 27, 1988, the Office of Investigations Region III Field Office advised Region til that their investigation was administratively closed (Enclosure 2).

Several questions about the NRC's regulatory authority in this matter arose as a result of this allegation. Those issues were discussed in two memoranda (Enclosures 3 and 4). The Office of Nuclear Reactor Regulation answered in a memorandum, dated June 1, 1988 (Enclosure 5).

The Enforcement and investigation Coordination Staf f and the Chief, Nuclear Materials Safety and Safeguards Branch, have reviewed the information contained in the inspection reports and the enclosed memoranda. Based on the infomation.

it appears that Region 111 has taken all of the actions necessary within Region Ill's authority and available resources to review and close this allegation file. Accordingly, the matter has been closed. in the Allegation Management System.
