SAFETY EVALUATION CONCERNING EXEMPTION FROM CERTAIN SECTIONS OF 10 CFR 50.47," EMERGENCY PLANS," AND 10 CFR 50, APPENDIX E, " CONTENT OF EMERGENCY PLANS," FOR THE BIG ROCK POINT PLANT (TAC NO. M99689) in response to your work request, dated September 30,1997, we have completed our review of Consumers Energy Company's (the licensee's) request for exemption from certain emergency preparedness requirements in 10 CFR 50.47 and Appendix E to 10 CFR Part 50 for the Big Rock Point Plant (BRP). The requested exemption would allow the licensee to discontinue offsite emergency planning activities and reduce the scope of onsite emergency planning.

Based upon our review of the licensee's analysis of the consequences of potential radiological events and an assessment by the Plant S/stems Branch on the bounding spent fuel drain down event, we conclude that the licensee's request for exemption is acceptable. Our conclusion on 4 the acceptability of the requested exemptions from 10 CRF 50.47(b)(9) and Section IV.E.A.4 of

Appendix E to 10 CFR Part 50 is contingent upon the licensee implementing its commitment to revise its Defueled Emergency Plan to specify that it will maintain the qpabilg to determine the potentialimpact of a radiological emergency to the general public. Based upon our review of the licensee's analysis of the consequences of potential radiological events and an assessment by the Plant Systems Branch on the bounding spent fuel drain down event, we conclude that the licensee's request for exemption is acceptable.
