SUBJECT- OfflCE OF INVES11 GAT 10N ADMINISTRATIVE CASE CLOSURE (AITS NO. F03003688)

On January ??,1988, the Office of Investigations Region 111 field Office administretively closed the attached investigation due to the lack of investigatory resources. This case was returned to the Region ill Staff for further reviev and action.

Administratively closed cases fall within the purview of NRC Manual Chapter 0517 (Management of Allegations), Part 111, Paragraph F (Resolution of Those M6tters Returned to the Staff By-01 Without Investigation). That paragraph provides in part, "Those matters which are returned to the Staff by 01 without investigation . . . will be handled by the staff as part of its normal process to resolve inspection findings. This may include additional inspections, written requests for information from the licensee, meetings between the staff -

and licensee or proceeding with enforcement action as appropriate on the basis of-the original or supplemented inspection findings or such other actions as appropriate.

If, af ter development of supplemental information or reassessment of the original finding the matter warrants categorization as a high priority, the matter may be referred to 01 again . . . "

As with earlier cases returned to the Staf f after being administratively closed by 01, the following should be included in your deliberations:

The case (s) will be reviewed and a determination will be made of:

1) whether s'ufficient informati! o n exists to lead the staff to a conclusion.that the indicated violations were made deliberately or with careless disregard of requirements; and 2) whether the indicated violations are safety significant.

If the answer to either of these questions is affirmative, the Division will reconnend appropriate enforcement action.
