SUBJECT:

ALLEGED VALVE TAMPERING AT BIG ROCK POINT (50-155) (AMS NO. RIII-87-A-0042)

On July 29, 1987 Region III forwarded a Request for Investigation concerning a valve tampering incident at the Big Rock Point Plant. At that time the investigation was requested, Region III informed the Office of Investigations that the Federal Bureau of Investigation (FBI) was considering the matter for investigation.

By memorandum, dated October 14, 1987, the FBI informed tne NRC that the FBI would not investigate the matter (Enclosed).

Further, Region III contacted Robert Alexander, the Consumers Power Company's NRC Liaison for the Big Rock Point Plant, on October 19, 1987.

Alexander infomed Region III Security Inspector, G. L. Pirtle, that the Consumers Power I;ompany ari the alleger have not yet settled the labor grievance, and the matter is pending before the Michigan Workman's Employment Compensation Board. Alexander advised that the proposed settlement agreement will have the alleger compensated for a knee injury.

In exchange, the alleger's employment discharge will become permanent and the alleger will agree that he will not bring any other actions against Consumers Power Company. On October 21, 1987, S. Guthrie, NRC Senior Resident at Big Rock Point, advised that Consumers Power Company infonred him the company and the alleger reached final agreement and the matter has been settled.

This matter was discussed with the Regional Administrator on October 20, 1987, and it was detemined the "normal" priority assigned to the matter on July 29, 1987 should remain the same.
