Dear Jay:

It was good to meet you during my DOL hearing (Case 85-ERA-24) on October 24th in Syracuse. Aftur the events of Bob Gramm's test-imony, the company witnesses were devaccated. Treadwell proved what a bafoon he was and Wes Williams tcatimony contradicted Treadwell's on most every peint. Treadwell perjured himself with his opening statement - "He cae manager of non-nuclear quality Accurance. " ne was removed from that position and that department in September and is now a standards engineer in the engineering department. It was all over from that point as far as we were concerned. Williams was removed from his supervisory position (as a contractor)early last summer.

Jeanne Schwartzott perjured herself from the testimony that she gave to Judge Feldman on September 6, 1985 to her testimony on October 24, 1935...all in the record! I wish you could have remained for all four days of the October hearing, you would have known our determination to see Justice prevail in this mat:cr.

In my testimony on October 23rd, I revealed the Significant Def-tciency (proven aa the purtoined document) and therefore, from that the company portion of the " cover-up" was revealed and proven. TddV man' Bob Gramm revealed that the NRC was aware of the Significant Deficiency from August 1984, in his testimony on the federal record. Since this was tied to a "stop work" recommendation in our Audit No. 4, edsw 4id not the NRC levy a severity Level 3 or L fine against the company no later than September 1984? My testimony date to the NRC investigation was on September 12, 1984 and Rich Matakas, the chief investigator did not even bring this out in the queations to me. By Cramm's own admission, the technical report has been issued and with this knowledge of a company

" cover-up", there still has been no punitive action taken against the company. Are we to assume, that the NRC itself, is involved in this

" cover-up"?

I warned Rich Matakas against such action in September 1984. I warned your Chairman Palladino against " whitewash" or " cover-up" in February 1985. And Rudy Norman warned Keith Christopher about any NRC attempt to " cover-up" this activity in June 1985. My concern is serious now because of the following:

On October 1, 1985 Ms. Billic F. Carde of the Covernment Acc-ountability Proj ec t requested from the NRC. the subject report through (FOIA) channels. I reviewed the material she received on October 28th and it was a pile of CARBAGE. Nothing similiar to the Investigative Report' On October 31, 1985 I made a formal (FOIA) request of Joe Felton (copy enclosed). This was responded to via form letter on November 6, 1985 with an (FOIA) number 85-735, stating that I would be hearing from them within two vecks. I do not want to receive GARBAGE, Jay! So for the record let me detail for you and the entire NRC the following report ,

This request,The Chairman ignored completely, (before he realized my personal connections in this Adninistration). The enclosed letter to President Reagan of August 27, 1985 is self-explanatory. I have heard from the White House, the NRC and the DOL concerning this memo. I also worked for Bill Brock (now Secretary of Labor) in 1980. After 19 years as an industry lobbyist inWashington, I need not tell you how many of the senior Senators and Congressmen I know on a first name social and business basis.

No, Jay, there is not going to be any NRC " cover-up" in this situation, you can go to the bank with that promise. I will not hesitate to use every Administration contact that I have to see that proper Justice is administered here. We did not go to the National Media in June because Keith Christopher begged Rudy Norman "to wait" -" wait for the Investigative Report, we might like it." That was June. This is now six (6) months later, Jay, and still no NRC reportthme beamsissued on our harassments. Do you see where I am coming from today.

The Administrative hearing is over for me and now we are progressing with the Lawsuit, which a Federal Judge interrupted last May 22nd. It has been two years since Audit No. 4. It has been over a year since the NRC OI investigation was completed and it took me 10 months to get the DOL hearing (Administrative remedy), which I should have had within 45 days of January 2, 1985...the clock is running! Your action.
