Dear Mr. Grimsley:

This request is made pursuant to the Freedom of Information Act (FOIA), 5 U.S. C. 522, as amsnded. UNION ASSOCIATES submits this request to the Nuclear Regulato.y Commission (NRC) to obtain

! documents regarding the following:

VENDOR LISTS FOR THE NINE MILE POINT 2 NUCLEAR PLANT AS COMPILED BY NIAGARA MOHWAK POWER (NIMO) OR ANY NIMO CONTRACTORS BETWEEN 1975 AND 1978, ALONG WITH DOCUMEMTATION REGARDING THE USE OF "E-BRITE" AT THE NINE MILE POINT 2 NUCLEAR FACILITY.

In your response, the NRC should consider "doc umen ts " to mean any and all forms of written communication, including internal NRC staff memoranda. Your response should also include, but not be limited to, the following:

reports, studies, plans, graphs, charts, di ag rams ,

memoranda, correspondence, test results, working papers, meeting notes and minutes, computer records and print-outs, notes and summaries of conversations and interviews.

These documsnts are specifically requested from, but not limited to, the following offices of the NRC:

Office of Investigations Office of Inspection and Audit Office of Nuclear Reactor Research Office of Inspection and Enforcement Office of Nuclear Regulatory Research Offica of Analysis and Evaluation of Operational Data Operating Reactors Branch of the Division of Licensing. .

1. Any company whi h supplied materials to NIMO or NIM 0's contractors for use in building the Nine Mile Point 2 nuclear plant.

2. Any documentation in which the use of "E-brite" was at Nine Mile Point 2 was documented.

3. All documents from the NRC to NIMO regarding E-brite use at Nine Mile Point 2.

4 All documents from NIMO to the NRC regarding E-brite use at Nine Mtle Poln 2.

In your response, please identify which documents correspond to each request itemized above. If any of the material covered by this request has been destroyed and/or removed, please provie all surrounding documentation, including, but not limited to to a description of the action (s) taken, relevant date (s) and Justification (s) for the action (s). .

For any documents or portions of documents you deny due to a specific FOIA exemption, please provide an index itemizing and describing the documents or portions of documents withheld.

Pursuant to Vaughn v. Rosen (I), 484 F.2d 280 (D.C. Cir. 1973),

cert, denied, 415 U.S. 977 (1974), the index is required to provide a detailed Justification of your grounds for claiming each exemption and an explanation of why each exemption is relevant to the document or portion of the document wittheid.
