Licensee Power Authority of the State of New York

(" Power Authority") and its counsel have received copies of West Branch Conservation Association's ( "WBCA 's " ) " Request to NRC Staff to Expedite Replies and Second Set of Interroga-tories to Staff, Licensees and State of N.Y."

The Power Authority takes no position with respect to the request made to the Commission Staff for expedited reply. We do, however, object to the service of additional interrogatories. In its Memorandum and Order (Formulating Contentions, Assigning Intervenors, and Setting Schedule) dated April 23, 1982 (the " April 23 order") (at p.22) the Board expressly established May 3, 1982 as the final date for filing interrogatories on matters under Commission Questions 3 and 4.

May 25, 1982 Page Two Compliance with the Board's order is particularly important given the expedited nature of this proceeding and the large volume of interrogatories the Power Authority must respond to in a short period of time Your additional interroga-tories, filed May 15, 1982, fail to meet the Order's dead-line by nearly two weeks.

The Power Authority does not believe that the Board's May 12, 1982 Mailgram was intended to vary the deadline contained in the April 23 Order and to permit the filing of new interrogatories. Both licensees herein took this position in their May 14, 1982 letter to the Board.

Accordingly, the Power Authority objects to WBCA's interrogatories as untimely and declines to respond thereto.
