Indian Point Units 2 and 3, Docket Nos. 50-247-S'P 50-286-SP
Dear Ms. Potterfield:
By motion of Nebruary 22, 1982, the New York Public Interest Research Group (NYPIRG) has moved the Atomic Safety and Licen' sing Board for an order directing New York State to prest.:rve and produce documents relating to the exercise scheduled for March 9.
I understand NYPIRG to be requesting New York State to provide: (1) revisions of offsite radiological emergency plans; (2) notes of meetings at which revisions to the plan were t
l discussed; (3) offsite radiological emergency scenarios for training I
sessions of February 17 and February 24; (4) notes made at those training sessions, and; (5) exercise evaluations by State personnel and consultants.
I have already provided revisions of offsite emergency plans to NYPIRG. along with other parties and participants.
Tliose revisions embody fully any notes taken at meetings discussing plan revisions.
Enclosed please find our copy of the offsite scenario for the training session of February 24.
We do not have the February 17 scenario nor have any notes made at those training sessions been preserved.
I also understand that NYPIRG seeks exercise evaluations' by State personnel and consultants.
The State will preserve those evaluations as we would have done anyway and provide a list, as we did for the previous Indian Point exercise.
However, we believe those evaluations are privileged.
In accordance with your 8303090319 830304 h
PDR ADOCK 05000247 O
(!
Amanda Potterfield, Esq. March 4, 1983 agreement with Mr. Glass of the Federal Emergency Management Agency, the issue of whether a privilege attaches to these evaluations, remains to be argued.
Sincerely yours, r
