NRC Special Proceeding
Dear Mr. Corren:
The interrogatory responses from the Greater New York Council on Energy are now more than a week late.
They were due to be served on June 23d.
When we spoke on June 27, you confirmed that the interrogatories had not been answered.
In addition, you refused to provide any estimate of when they would be ready, other than it would be within two weeks, that is, by July 13th.
Further, you rejected my request that you supply interrogatory responses that were now available, with any incompleted responses to be furnished later.
This attitude is in flat contradiction to the philosophy and practice governing exchange of information in this special proceeding.
The time for completion of the proceeding is not unlimited, as the Nuclear Regulatory Commission has requested I
that the Licensing Board provide their recommendations by Sep-tember 18, 1982.
As a result, all parties other than GNYCE have worked to provide interrogatory responses on a timely basis.
l GNYCE's refusal to provide interrogatory responses now available is wholly inconsistent with GNYCE's request, made i
l through Jeffrey Blum, that the licensee: furnish their responses i
to GNYCE's interrogatories in advance of the date provided by l
the rules.

9 Dean Corren, Director Greater New York Council on Energy July 2, 1982 Page Two GNYCE's default on discovery and your unwillingness to cooperate with licensees in effecting the transfer of requested information constitutes a threat to the orderly carrying out of trial-type procedures underlying this special proceeding.
Very truly yours, Gha h M sa L Charles M. Pratt Assistant General Counsel CMP:CAC Attachment cc:
