April 8, 1980 Page 2 On March 5, 1980, Houston filed a motion to compel with res-pect to the deposition of the NRC Staff's expert witness, Dr.

Norman D. Lerner. Pursuant to the March 13 Board Order, on March 17 the NRC Staff produced additional documents in response to Houston's Second and Fourth Sets of Interrogatories.

Houston is working informally with the Staff as to further required production.

On March 18, Houston supplemented its answers to the NRC Staff's First and Third Sets of Interrogatories and Document Requests.

On March 6, HLP responded to the Department's motion to com-pel supplementation of its First Set of Interrogatories, by stat-ing that the supplemental answers had already been submitted.

On March 13, Houston informally wrote to the Departkaent, seeking clarification of the Department's intent to use Mr. Carl Stover as an expert witness, and requesting Mr. Stover's studies and work papers. Although Houston attempted to use informal communication, and asked for an expedited reply, the Department has never responded substantively, and Houston remains unable to productively depose Mr. Stover.

On March 14, upon Houston's request, the Board issued a sub-poena for the deposition of Mr. F. George Arey, of the Stone and Webster Engineering Corporation.

On March 26, Houston filed two separate motions to compel production of documents subpoenaed from the files of the Midwest Electric Cooperative and its General Manager, Mr. Parker Wetzel; and of documents subpoenaed from the files of the Southwest Texas Electric Cooperative and its General Manager, Mr. Elton McGinnis.

Houston has agreed to a two-week extension of time in which to reply to these motions.

During the month, Houston also informally received or pro-duced documents with the Department, the NRC Staff, and PUB.
