This is the monthly discovery report of the Public Utilities Board of the City of Brownsville for the months of March and April, 1980.

Brownsville's potential expert economic witness for antitrust issues, Dr. John W. Wilson, was deposed on March 24-26. Brownsville also participated on March 31 in the deposition of Glenn Stagg, an economic expert witness for Houston Lighting & Power Company ("HL&P").

The deposition of Mr. William R. Mayben, Brownsville's potential expert engineering witness, was postponed by agreement and has not been rescheduled.

Brownsville did not participate in the deposition of Central and South West ("C&SW") employee James Bruggeman, c which had been scheduled for March 7, 1980, in Chicago, Illinois. Although Brownsville expressed its interest in participating in this deposition to counsel for C&SW and HL&P (which noticed the deposition), it was unable to participate because of a misunderstanding between counsel, in that Brownsville was not timely informed that Mr. Bruggeman's deposition had been moved from March 7 to March 6.

Brownsville still has ' not received a complete copy from Central Power & Light Company ("CP&L") of the November 29, 1968 internal memorandum describing a) negative responses by several members of the Texas Interconnected System to

Brownsville's 1968 request for admission to TIS, and b)

CP&L's discussions with the Comision Federal de Electricidad regarding Brownsville's interest in interconnection with Mexico and consequent transmission of power from the Amistad Dam to Brownsville. This item is in abeyance pending settle-ment discussion.

Brownsville has provided to counsel for HL&P (and to other counsel as requested) documents relating to the pre-paration for deposition of Dr. John W. Wilson.

During April, HL&P filed a Motion to Compel Production of Documents, to which Brownsville responded.

Brownsville has not yet received answers to its Second Set of Interrogatories and Requests for Production of Documents to Central and South West Corporation. The Board required C&SW to respond fully in an Order dated March 18, 1980. Counsel for C&SW, in a letter dated April 16, 1980, had stated that responses "are being prepared." C&SW and l CP&L are in default on this item.

During March Brownsville received supplemental reports from the C&SW companies.

Although Brownsville has now received a number of docu-

ments from Texas Utilities and its subsidiaries, it has no' yet received all of the documents it requested in November, 1979.

Brownsville continues to analyze documents, supplemental answers and deposition testimony as it receives them.
