Mr. Theodore SullivanSite Vice President Entergy Nuclear Northeast James A. FitzPatrick Nuclear Power Plant Post Office Box 110 Lycoming, NY 13093

SUBJECT: JAMES A. FITZPATRICK - NRC SPECIAL INSPECTION REPORT 05000333/2005009

Dear Mr. Sullivan:

On October 27, 2005, the NRC completed a Special Inspection at the James A. FitzPatrickNuclear Generating Station. The enclosed report documents the inspection results which werediscussed on October 27, 2005, with Mr. David Wallace and other members of your staff. The Special Inspection Team (SIT) examined activities related to the June 27, 2005 discoveryof a through-wall leak in the torus shell, which subsequently resulted in the plant being shutdown on June 30, 2005. The SIT also examined activities associated with a leak in the shutdown cooling (SDC) suction pipe wall of the residual heat removal (RHR) system that wasidentified after plant shutdown. The activities inspected by the SIT were those conducted underyour license as they relate to safety and compliance with the Commission's rules and regulations and with the conditions of your license. The inspectors reviewed selected procedures and records, observed activities, inspected plant components, and interviewed personnel.Based on the results of this inspection, the report documents two self-revealing findings of verylow safety significance (Green). One of these findings was determined to involve a violation of

NRC requirements. However, because of the very low safety significance and because it isentered into your corrective action program, the NRC is treating this violation of a requirementas a non-cited violation (NCV) consistent with Section VI.A of the NRC Enforcement Policy. Ifyou contest the NCV or the Green finding without an NCV in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN.: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator Region I; the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001; and the NRCResident Inspector at FitzPatrick.

Mr. T. Sullivan2In accordance with 10 CFR 2.390 " Public Inspections, exemptions, requests for withholding," acopy of this letter and its enclosure will be available electronically for public inspection in theNRC Public Document Room or from the Publically Available Records (PARS) com ponent ofthe NRC's document management system (ADAMS). ADAMS is accessible from the NRCwebsite at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
