NOTICE OF VIOLATION Houston Lighting & Power Company DocketNb. 50-498/499 South Texas Project Licerse No. NPF-76/CPPR-129 Bay City, Texas EA No.88-216 During an NRC investigation conducted on January 29 - April 15,1988, a violl. tion of NRC requirements was identified. In accordance with the "Generai '

Statement of Pc,11cy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988}, the violation is listed below:

10 CFR Part 50, Appendix R.fl.A. requires that a fi e protection program shall be established at each nuclear power plant and that the program shall establish the fire protection policy for the protection of structures, systems, and components important to safety at each plant and the procedures, equipment, and ,

personnel required to implement the South Texas Project (STP) Station Procedure (SP) program at the OPGP03-ZF-0001, plant "Fire site. Program,"

Protection Revision 4, dated January 20, 1988, describes the STP Fire Protection Prt, gram and provides that controls to ensure acceptable performance of fire protection systems and personnel shall be described in approved precedures.

STP SP OPGP03-ZF-0018, "Fire Protection System Operability Requirements,"

Revision 4, dated October 28, 1987, Paragraph 4.8.1.2, requires that an hourly fire watch be e:tablished as a compensatory action if a requireo fire rated

'assbly or sealing device is inoperable and fire detertion is operable on At least one side of the inoperable assembly. STP SP OPGP034ZF-0013, "Fire Wttch Program," Re.ision 1, dated July 21, 1987, Paragraph 5.5, requires that personnel assigned to act as hourly fire watches shall pass through the required areas et least once in every 60-miilute period checMr,g for signs of fire.

Contrary to the above, on at least six evenings tsetween December 6,1947 and January 23, 1988, an STP fire watch supervisor and two STP fire watch personnel assigned STP Five Protection System compensatory hourly fire watches initialed Fire Watch Logs indicating they Md passed through the required areas at least once in every 60-minute period checkfng for signs of fire when, in fact, they had not passed through the required areas at least once in every 60-minute period.

! This is a Severity Level IV violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, HL&P is hereby required to submit a writter, statement or explanation to the U.S. Nuclear Regulatory Comis,1cn, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, and if applicable, a copy to the NRC

Resident inspector, within 30 days of the date of the letter transmitting this Notice, This reply, shculd be clearly marked as 4 "Reply to a Notice of Violation" and should include for each violatier

o violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
