i March 27, 1997 Mr. J. K. Thayer, Recovery Officer Nuclear Engineering and Suppwt Services Northeast Utilities Service Company P.O. Box 128 Waterford, CT 06385 SUBJECT: REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (Haddam Neck Plant, Millstone Nuclear Power Station, Units 1,2, & 3)

(50-213, 50-245, 50-336, 50-423)

Dear Mr. Thayer:

In a letter dated March 3,1997, Connecticut Yankee Atomic Power Company (CYAPCO)

and Northeast Nuclear Energy Company (NNECO) submitted a response to the NRC's initial Operator Licensing Examination Report No. 50-245/96-12, dated February 7,1997. Prior to responding, NNECO's Recovery Officer - Nuclear Engineering and Support commissioned an Independent Review Team to assess the circumstances surrounding the examination failures. Attached to the letter is a copy of the IRT report, dated March 1997. In the letter it is requested that portions of the IRT report be withheld from public disclosure pursuant to 10 CFR 2.790. The March 3,1997 letter also contained an affidavit in support of NNECO's request and nonproprietary version of the IRT report.

NNECO stated that the March 1997 IRT report should be considered exempt from mandatory public disclosure for the following reasons:

1. The information contained therein contains personnel information, the public disclosure of which would constitute a clearly unwarranted invasion of personal privacy. The information identifies individuals who were involved with the matters being investigated in NNECO's @w, public disclosure of the information would invade the personal privacy of these nMividuals.

2. The personal privacy information contained in NNECO's response, to the best of your knowledge and belief has not been disclosed to the public.

We have reviewed NNECO's request and the materialiri accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted !

information sought to be withheld contains personnel information, the disclosure of which would be a clearly unwarranted invasion of privacy.
