Murdock j 534 Princeton Avenue Bayville, NJ 08721-2333 l Dear Mr. Murdock-1 I have been asked to respond to your letter to Assemblyman Moran, dated September 9,1998, regarding the possible closure of Oyster Creek Nuclear Generating Station (OCNGS) and the possible impact that closure may have on the enonomy and the environment of the community.

Primarily because of the established economic regulatory process, the U.S. Nuclear Regulatory Commission (NRC) has exercised limited financial oversight of electric utility licensees. The electnc industry's move away from traditional rate-bcsed regulation toward increased competition in a deregulated marketplace could have an adverse in osct on the long-term ability of utilities to i adequately finance safe operation and decommissioning of their nuclear power plants.

Although the NRC is not usually involved in economic or rate regulation, over the years the l agency has recognized a possible relationship between adequate financing and safe operations.

! Licensees' efforts to reduce spending could result in smaller, less-experienced workforces;

! reductions in maintenance and cacital budgets; shorter refueling outages, during which certain maintenance is performed; and a decline in training resources. The NRC must ensure that economic pressures do not result in reduced safety margins at operating nuclear plants and de not impair a licensee's ability to fully finance decommissioning at a plant after it is shut down.

l l It also should be noted that the staff has historically not found a strong correlation between levels of operation and maintenance (O&M) and capital additions expenditure and measures of safety performance. Many plants have increased capacity factors and reduced O&M costs and continue to demonstrate excellent safety performance. The NRC will continue to monitor OCNGS through the inspection process and other plant performance indicators used to assess safe plant operation. i With respect to some other issues you raised, and as indicated by your 9th District representatives in a letter to you dated September 22,1998, there is considerable activity at the State level to develop long-term strategies to address the socioeconomic and environmental

issues surrounding the OCNGS facility.

l l hope this letter is responsive to your concems regarding the safe operation of OCNGS until a final decision is made regarding the future operation of the facility.

We completely share these and many other profound concerns. That is why we have pushed so hard for legislation to establish a Task Force for the decommissioning of this Nuclear Generating Station to develop long-term strategies to address the socioeconomic and environmental issues surrounding this facility. To save precious jobs and careers. To diminish the potential economic effects on many communities here in the region.

As you may know, the overall oversight of the Oyster Creek Nuclear Generating Station rests within the Federal Nuclear Regulatory Commission. The NRC has the responsibility to oversee this facility during its operation and eventual closure at some point in the future, hopefully, at the conclusion of its full licensure expectation in 2009 or beyond. In an effort to try to be of assistance to you in looking into your concems as they pertain to the NRC, by copy of this reply. we are forwarding a copy of vour letter to NRC Conunissioner Shirlev Ann l Jackson. This convevance formally requests Cornmissioner Jackson to thoroughly review the issues you raise.

In the area of state responsibility, you may rest assured that many efforts are underway to l establish a deregulation process for the electric industry that both reflects the changing marketplace for electricity, as well as the needs of consumers, based upon federal laws and court decisions. You will also be encouraged to know that Lacey Township's state funding,in lieu of property taxes for this facility, has been safeguarded by recent changes in state law. Dear Assemblyman Moran,

I am writing this letter to express my concern about deregulation and how it will effect the environment we live in. This deregulation plan does not recognize the positive impact Oyster Creek Nuclear Generating Station has to the environment. If Oyster Creek is prematurely closed it will threaten our base load and increase production of our coal and gas plants, increasing carbon pollutants and present a decommission cost to the rate payers.

The great loss of revenue to the County and Township will be devastating. New Jersey can not afTord the loss of thousands ofjobs and jeopardize the reliability of electricity for a deregulation plan with false promises of saving the rate payer money.

As Emergency Coordinator, I represent about one hundred amateur radio operators in Ocean county. They all share the concerns that I have stated above. As volunteers, amateur radio operators demonstrate that they tru!y care about the people of Ocean County and not " big business" concerns and prctits. % all speak from our hearts when we say that deregulation of electricity is a mista'<e.

l I am writing this letter to express my concern about deregulation and how it will effect the environment we live in. This deregulation plan does not recognize the positive l impact Oyster Creek Nuclear Generating Station has on the environment. In the event t .

that Oyster Creek is prematurely closed, it will threaten our base load and increase '

, production of our coal and gas plants, increasing carbon pollutants and presenting a 1

decommission cost to the rate payers.

The great loss of revenue to the County and Township will be devastating. New Jersey can not afford the loss of thousands ofjobs andjeepardize the reliability of electricity for a deregulation plan with false promises of saving the rate payer money.

Dear Senator Connors,

I am writing this letter to you to express my concern about the deregulation of the electric industry in New Jersey, how this will effect the emironment and the economic impact that will be felt throughout the state.

i The premature closing of the Oyster Creek plant, which is performing excellently and has set new records for efficiency and worker protection in low exposures, will have a devastating impact on the Local and State economy through the loss of highly skilled jobs, the taxes paid on those wages and the revenue spent in the surrounding areas.

Additionally, nuclear power generation does not increase the pollutants in the air like coal and gas powered plants. The closing of the Oyster Creek plant prematurely threatens the base load generation in the state and will increase the pollutants by increasing production at the carbon based fuel plants, especially those in west of New Jersey that do not have the same clean air standards.

The loss of revenue to the local economy at the County and Township level will be tremendous. Ocean County and Lacey Township can not afford to lose nearly 1000 or morejobs. New Jersey can not afford to lose this tax-based revenue and tojeopardize the reliability of electricity for a deregulation plan with false promises of savings to the ratepayer.

Having just recently moved from Fennsylvania to Ocean County, I can attest to the fact, that there is NO silver lining hiding inade electric deregulation as promised. I feel that

! deregulation of the Electric Industry in New Jersey is a very bad idea, that only has the l potential to place more of a financial burden on the common working class person. Just l look at what it has already done in Pennsylvania. While promising an initial decrease, we all know it will result in an increase to cover the delivery portion the provider must pay.

Think about all of the other industries that are now deregulated and what have been the consequences of their deregulation on the common tax payer. Take all the airline mishaps that have ocurred since that industry has been deregulated. How about all the major power outages that have plagued the western statesjust this year alone? Do we really want to put ourselves in that same, very uncomfortable position? Speaking for 1 myself,I do not!

To add to the list of BAD ideas, there is talk that the Oyster Creek Nuclear Generating Station may be closed, putting close to eight hundred people out of work in the name of DEREGULATION. This will not only effect their families, but the many small local businesses that have come to depend on the revenue that is a direct result of the Power Plant being in operation. As a fellow resident of New Jersey, please tell me how that serves the common good!

This deregulation plan does not recognize the positive impact Oyster Creek Nuclear Generating Station has to the emironment. If Oyster Creek is prematurely closed it will threaten our baseload and increase production of our coal and gas fired plants, increasing carbon pollutants in an already emironmentally sensative area. This plan also allows decommissioning costs to be paid by the ratepayer which is unfair, I find it extremely difficult and hard to believe that a company that has profited billions of dollars from the people of the state of New Jersey would be allowed to dictate its agenda to the rate payers. This company has recently spent billions of dollars in overseas investments with the money earned in New Jersey. How can you possibly trust a company with hidden agendas. Were are the billions of dollars spent here in the USA? Non-existent I'm sure. As a Representative of New Jersey, I am asking you to look into these and other problems deregulation will bring upon us.

1 am writing this letter to express my concems about the possible premature closing of Oyster i Creek, which has been performing excellently. It's closing, I believe, will have negative economic and environmental effects.

Since the mid 1980s Oyster Creek and the Nuclear Enerhy Institute have made great strides. We have become safer and more productive. All of the industry performance indicators show this improvement.

The environment is of great concern to all of us and nuclear generation is one of the only two ways now commonly used to produce electricity that emits no greenhouse gases. Thinking of the environment; when deregulation comes irmeffect, we will be forced to buy dirty electricity from out-of-state carbon dioxide emitting, fossil-fuel buming plants.

In 1995 alone, natural gas emitted 150 metric tons of carbon dioxide, oil emitted 190 metric tons and coal emitted 230 metric tons,in order to produce one million kilowatt hours of electricity.

Nuclear plants do not generate any carbon dioxide!

I often hear people say that nuclear power plants can't compete with other generating sources. No doubt some individual plants will not be competitive, but if you look at what Oyster Creek has done and continues to do, we can be competitive. On average nuclear power is only marginally more expensive than other types of generation. Unlike other generating sources, the figures for nuclear generation include the cost of waste disposal and decommissioning.

The Energy Information Administration estimates the cost to build new fossil-fueled baseload capacity plants to be from $440.00 per kilowatt for a 400-megawatt combined-cycle gas plant to over $1,000.00 per kilowatt for the same size coal plant.

Between 1973 and 1996 nuclear energy met 40 percent of the increased demand for electricity in the United States. At the same time prevented the emission of 80 million tons of sulfur dioxide and 34 million tons of nitrogen oxide. The United States target is to cut carbon emissions 7 percent below the 1990 levels by the year 2004. -

l At this time, the EPA's preferred method of regulation is the " cap and trade" system. In other words, if a company wants to exceed its pollution limit, it can purchase the right to do so from companies that have reduced emissions. The irony of this is; in order to participate, a company

( must actively pollute. Since nuclear plants do not pollute, they are not participants in the " cap and i trade" process. Tradable credits should be earned not only on the basis of reduced emissions, but as a function ofdisplaced emissions as well. Existing and future nuclear energy sources should be preserved. '

I encourage you to recognize the economic and environmental contributions of nuclear energy.

I 'ask: If they close Oyster Creek, where will this additional loss of electricity come from? I Answer: Out-of state dirty electricity at a loss ofjobs and mvenue to New Jersey.

In an effort to try to be of assistance to you in looking into your concerns as they pertain to the NRC, by copy of this reply. we are forwarding a copy of your letter to NRC Commissioner Shirlev Ann Jackson. This convevance formally requests Commissioner.Tackson to thoroughly review the issues you raise.

In the area of state responsibility, you may rest assured that many efforts are underway to establish a deregulation process for the electric industry that both reflects the changing marketplace for electricity, as well as the needs of consumers, based upon federal laws and court decisions. You will also be encouraged to know that Lacey Township's state funding,in lieu of property taxes for this facility, has been safeguarded by recent changes in state law. Our Delegation led the fight to protect Lacey Township from any diminished funding of its gross receipts and franchise revenues.

Deregulation and The Oyster Creek Nuclear Generating Station I

I am writing to you requesting that when dealing with the upcoming electric utility deregulation in NJ, That all possible actions be looked at to keep the Oyster i Creek Nuclear Generating Station operating until the end of it's licensed life in 2009. l l As you are aware the Oyster Creek plant provides hundreds of good paying hi-tech l L . Jobs for Ocean County and spends millions of dollars which provides many other jobs l In the area. The loss of this major employer will definitely have a negative impact on l Lacey Township along with the Ocean County area. Additionally, with the growing concern related to pollution from burning fossil fuels, the power from Oyster Creek is non-polluting. I suggest the following items be looked at concerning this matter:

(1) When determining the amount of stranded investment that GPU receives related to Oyster Creek, please ensure a fair balance but do not allow it to be an incentive for GPU to close the plant. (2) Please ensure that adequate amounts of non polluting power is available for replacement. (3) Ensure the electrical distribution grid in the area can afford to lose Oyster Creek without putting the area in danger of relying on l single distribution lines and the potential for brown or black outs during periods of peak demand in the summer and winter months. This is vital to support the important tourist industry in Ocean County. .

This transition period is very uncertain for the utility industry with great uncertainty as to demand and market price for power. Oyster Creek's costs are not that far from other plants and is in the same cost quartile of U.S. Nuclear Plants as PSE&G's Hope Creek Nuclear Station. Additionally, even GPU's estimates show Oyster Creek turning the corner related to market prices in as early as 2002. Perhaps the best approach would be a transition to deregulation for NJ based generation, or a different pricing structure based on a plant's location and importance to power grid stability. These actions would be valuable for plants like Oyster Creek to continue to provide needed clean, reliable power along with keeping the generation jobs in NJ.

I am writing this letter to express my concern about deregulation and how it will effect the environment we live in. This deregulation plan does not recognize the positive impact Oyster Creek Nuclear Generating Station has to the environment. If Oyster Creek is prematurely closed it will threaten our base load and increase production of our coal and gas l plants, increasing carbon pollutants and present a decommission cost to l the rate payers. l 1

The great loss of revenue to the County and Township will be ,

devastating. New Jersey can not afford the loss of thousands ofjobs and l jeopardize the reliability of electricity for a deregulation plan with false promises of saving the rate payer money.
