REQUEST FOR ACTION UNDER 10 CFR 2.206 CONCERNING CATAWBA UNITS 1 AND 2 i
The enclosed petition filed before the Conmission by GAP on behalf of the Palmetto Alliance has been referred to the' staff for consideration 'as a request for action under 10 CFR 2.206. */ The petition requests "immediate action" to require a management audit and an independent review of the as-built deficiencies and the quality assurance program. GAP also requests an investigation of Duke Power Company's handling of complaints by welding inspectors and an investigation of conduct by NRC personnel with respect to the matters outlined in the petition. Although this latter request pertaining to the conduct of NRC officials is esser.tially outside the scope of actions covered by 2.206, it may be appropriate for action by OIA.
"      Because the petition generally concerns matters within the responsibility of 1&E,1&E appears to be the most appropriate office to respond to the petition. Due to the nature of the factual allegations in the petition and the perdency of related issues in the operating license proceeding, any response should be closely coordinated with Region II and NRR. We will work with your staff in developing an appropriate response to the petition. In the treantime, you should acknowledge receipt of the petition and issue the standard Federal Register notice which indicates the petition is under consideration. I have enclosed drafts of a letter and notice for your use. -
Issuance of the acknowledgment letter should be coordinated with OIA. please note that it may be appropriate to add a more detailed ep.planation in the acknowledgment letter for declining immediate action on the petition.
