OurofficehasreviewedtheSusquehannaSteamElectricStation,UnitsOneand.Two,DraftEnvironmentalStatementDraftSupplement,ConynghamTownshipofLuzerneCounty,Pennsylvania,inkeepingwith.thisoffice'sdirectresponsibility.Thisagency'sareasofconcernarefloodcontrolhazardpotentials,,permitrequirementsunderSection404oftheCleanWaterAct,andotherdirectandindirectimpactsonCorpsofEngineersexistingand/orproposedprojects.Inaccordancewiththeseresponsibilities,ourofficehasthefollowingcomments:a.TheproposeddamistobeconstructedinwatersoftheUnitedStatesandis,,therefore,subjecttotheregulatoryauthorityofthisoffice.However,sincetheproposeddamistobeconstructedabovetheheadwatersofPondHillCreek,theworkisauthorizedundertheprovisionsofaDepartmentoftheArmyNationwidePermit.Theattached'sheetdescribestheconditionswhichmustbesatisfiedforthepurposesofSection404oftheCleanWaterAct,andtheManagementPracticeswhichshouldbefollowed,tothemaximumextentpracticable,inthedischargesofdredgedorfillmaterialtominimizetheadverseeffectsofthesedischargesontheaquaticenvironment.Theproposedintakestructureistoextendapproximately30metersintotheSusquehannaRiver,anavigablewateroftheUnitedStates,therefore,anindividualDepartmentoftheArmypermitfortheintakewouldberequiredinaccordancewithSection10oftheRiverandHarborAct.b.Asnotedin4.4.2.3,HydrologicDesignonDam,page4-11,theproposedspillwaywouldbeinadequateforpassingthePMFusingNRCcriteria.Thus,apotentialfloodhazardwouldexistfromfailureofthedamduetoovertopping.Thedocumentshouldaddressthisfloodhazard.
