Chisum Site Vice President Entergy Operations, Inc. 17265 River Road Killona, LA 70057-0751 SUBJECT: WATERFORD STEAM ELECTRIC STATION, UNIT 3 - NRC SECURITY INSPECTION REPORT 05000382/2016406 AND RESPONSE TO DISPUTED NON-CITED VIOLATION  Dear Mr. Chisum:  On November 2, 2016, the U.S. Nuclear Regulatory Commission (NRC) issued the subject inspection report and non-cited violation (NCV) concerning activities conducted at your facility (Agencywide Documents Access and Management System (ADAMS) Accession ML16307A228).  On December 15, 2016, Mr. John Jarrell, Regulatory Assurance Manager, provided a response (ADAMS Accession ML16350A400) that contested a Green security-related NCV described in the inspection report.  Both the NRC's inspection report and your response contained Security-Related Information and are not publicly available.  On December 22, 2016, we issued an acknowledgement letter informing you that we would review your basis for contesting the NCV (ADAMS Accession ML16362A449). 
The NRC conducted a detailed review of your response and the applicable regulatory requirements, in accordance with Part I, Section 2.2.7, of the NRC Enforcement Manual.  The NRC staff who performed the review included personnel that were not involved with the original inspection effort.  After careful consideration of the basis for your denial of the NCV, the NRC has concluded that the NCV is appropriate and that the subject inspection report adequately describes the finding.  As a result, the NRC is upholding the NCV contained in the inspection report.  The results of the NRC's evaluation containing Security-Related Information are provided in the enclosure to this letter.  In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRC's "Rules of Practice and Procedure," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room and in ADAMS, accessible from the NRC  UNITED STATES NUCLEAR REGULATORY COMMISSION REGION IV 1600 E. On November 2, 2016, the U.S. Nuclear Regulatory Commission (NRC) issued the subject inspection report and non-cited violation (NCV) concerning activities conducted at your facility (Agencywide Documents Access and Management System (ADAMS) Accession ML16307A228). On December 15, 2016, Mr. John Jarrell, Regulatory Assurance Manager, provided a response (ADAMS Accession ML16350A400) that contested a Green security-related NCV described in the inspection report. Both the NRC's inspection report and your response contained Security-Related Information and are not publicly available.
