SUBJECT: WATERFORD STEAM ELECTRIC STATION, UNIT 3 - ACKNOWLEDGEMENT

OF RESPONSE TO NRC INSPECTION REPORT 05000382/2023004 AND

DISPUTED NON-CITED VIOLATION

Dear Joseph Sullivan:

This letter acknowledges your March 11, 2024, correspondence (Agencywide Document and

Access management System (ADAMS) Accession No. ML24071A185 sent in response to the

U.S. Nuclear Regulatory Commission (NRC) Inspection Report 05000382/2023004

(ML24039A199) dated February 12, 2024. In your letter, you dispute one non-cited violation

(NCV 05000382/2023004-03) associated with the failure to ensure the starting batteries for the

Diverse and Flexible Coping Strategies (FLEX) N and N+1 diesel generators had specific

capacity to perform their required functions. The NRC is currently reviewing your basis for

contesting the violation in accordance with Section 2.8 of the Enforcement Manual, dated

December 2023. Accordingly, we plan to provide the results of our review by written response

within 90 days of receipt of your March 11, 2024, letter.

In accordance with 10 CFR 2.390, Agency Rules of Practice, a copy of this letter will be made

available electronically for public inspection in the NRC Public Document Room or in the NRCs

ADAMS, accessible from the NRCs website at http://www.nrc.gov/reading-rm/adams.html.
