APPENDIX A ,

NOTICE OF VIOLATION Power Authority cf the State of New York Docket No. 50-333 James A. Fitzpatrick Nuclear Power Plant License No. DPR-59 As a result of the inspection conducted on July 21-25, 1986, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following vio-lation was identified:

Section 7.2 of Technical Specifications states, in part, that written procedures shall be established, implemented, and maintained that meet or exceed the requirements and recommendations of ... Regulatory Guide 1.33, November 1972, Appendix A. Section H of Appendix A to Regulatory Guide 1.33 requires procedures for control of measuring and test equipment, including laboratory equipment, as well as procedures for environmental monitoring calibrations.

Contrary to the above, Procedure ESP-14, "LB 5100 Low Background Counter,"

for control of laboratory alpha-beta counter was not properly implemented, in that step 4.4.8, which requires establishment of the alpha plus beta response curve (counts per minute versus voltage), was not followed when this instrument was calibrated.

This is a Severity Level V violation (Supplement I).

No response to this finding is required because corrective actions to prevent recurrence were taken prior to the conclusion of the inspection.
