CALLAWAY PLANT, UNIT 1: ACCEPTANCE OF APPLICATION FOR APPROVAL OF CYBER SECURITY PLAN AMENDMENT (TAC NO. ME4536).

Dear Mr. Heflin:

By letter dated November 19, 2009 (non-publicly available), as supplemented by letters dated January 21 and June 9, 2010 (Agencywide Documents Access and Management System (ADAMS) Accession Nos.

ML100210818 and ML101610642, respectively), Union Electric Company (UE, licensee) requested an amendment to the Facility Operating License for Callaway Plant, Unit 1 Facility Operating License No.

NPF-30. In its letter dated August 12, 2010 (ADAMS Accession No. ML102250075), UE stated that it withdraws the previously submitted amendment request and proposes, instead, the license amendment request as enclosed in its August 12, 2010 submittal.

The proposed License Amendment Request includes the cyber security plan, proposed changes to Section 2.E. of the Facility Operating License No. NPF-30, proposed Cyber Security Plan Implementation Schedule, evaluation of the proposed change, and a summary of deviations between the Callaway Plant Unit 1 Cyber Security Plan and the cyber security plan template presented in NEI 08-09, Revision 6. The proposed cyber security plan has been submitted in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 73.54, Protection of digital computer and communication systems and networks.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of the Callaway Plant Unit 1 August 12, 2010 amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its

characterization of the regulatory requirements or the licensing basis of the plant. Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license must fully describe the changes desired, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application and has determined that the application reasonably appears to contain sufficient technical information, both in scope and depth, for the NRC staff to complete the detailed technical review and render, in an appropriate time frame for the associated action, an independent assessment of the proposed action with regard to applicable regulatory requirements and the protection of public health, safety, and security.

If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
