CALLAWAY PLANT, UNIT 1 - ACCEPTANCE OF REQUESTED LICENSING ACTION RE: REVISION TO TECHNICAL SPECIFICATIONS 3.8.4 AND 3.8.5(TAC NO. ME0292).

Dear Mr. Heflin:

By letter dated December 29, 2008 Union Electric Company (the licensee) requested the U.S.

Nuclear Regulatory Commission (NRC) staff for approval of a revision to Callaway Plant, Unit 1 Technical Specifications (TS) 3.8.4 and 3.8.5, "DC Sources-Operating" and "DC Sources-Shutdown" respectively.

The proposed amendment would revise the battery connection resistance limits in Surveillance Requirements (SR) 3.8.4.2 and 3.8.4.5 from 150 micro-ohms (150E-6 ohms) 69 micro-ohms (69E-6 ohms). TS 3.8.5 is affected by virtue of SR 3.8.5.1 invoking both SR 3.8.4.2 and SR 3.8.4.5 for DC sources that are required to be operable in Modes 5 and 6.

The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff=s acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed the application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed revision to TS 3.8.4 and 3.8.5 in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised of it by separate correspondence.
