Dear Mr. Elwood,

By application dated February 8, 2022 (Agencywide Documents Access and Management System Accession No. ML22039A317), Union Electric Company, a wholly owned subsidiary of Ameren Corporation, requested U.S. Nuclear Regulatory Commission (NRC) review and prior approval of changes to revise the Callaway Plant Radiological Emergency Response Plan (RERP). The proposed changes to the RERP would remove the normal hours response and activation goal; and extend the State and counties notification and follow up notification goals. In order to complete their review of the application, the NRC staff has provided the following requests for additional information (RAIs) needed to facilitate the technical review being conducted by the NRC staff. A timely and accurate response to these draft RAIs is requested.

Regulatory Requirements:

10 CFR 50.47(b)(5) requires, in part, the content of initial and followup messages to response organizations and the public has been established.

Associated guidance in NUREG-0654,Section II.E, Evaluation Criterion E.5 states that the licensee, state, local, and tribal government organizations make provisions to provide timely supplemental information periodically throughout the radiological incident to inform the public.

Issue:

Sections 2.2 and 3.2 of Enclosure 1, Description of the Proposed Changes, state that the changes have been discussed with the State and emergency planning zone (EPZ) counties.

Sections 2.2 and 3.2 further state that the State and EPZ counties agreed with the changes.

However, no letters or other document was provided by the State and EPZ counties that specifically indicate agreement with the proposed changes. Additionally, no discussion was provided that would indicate that State and EPZ emergency response plans either would not be impacted or would be changed as needed to ensure consistency with the proposed changes to the Callaway Plant RERP.

RAI 1

Request 1.a: Provide a letter or other document indicating that State and EPZ counties agree with the proposed changes to the Callaway Plant RERP.

Request 1.b: Provide a letter or other document indicating that there will be no impact to the radiological emergency response plans of the State and EPZ counties or the plans will be changed as needed to be consistent with the proposed changes to the Callaway Plant RERP.

A clarification call was held with the NRC staff on 6/15/2022. There was no need to make any changes to the above request as a result of this call. Following the call you agreed to provide the response to this request for the final RAI on the docket prior to July 15, 2022.
