NRC TO MONITOR AND ASSESS REVIEW 0F LAWSUIT RECORDS BY HOUSTON LIGHTING & POWER The Nuclear Regulatory Comission staff has been informed by Houston Lighting &

Power Company (HL&P) that HL&P will review records of a recently settled lawsuit involving HL&P, its partners, and Brown & Root, Inc. to see if the documents contain any matters of safety significance which might affect the South Texas Nuclear Project.

NRC endorses this approach, Robert D. Martin, NRC Region IV Administrator in e Arlington, Texas, said. He added that NRC will monitor the company's review while it is under way and also will assess the review's adequacy once it is completed. Documents to be reviewed include deposition transcripts and other records produced during the pre-trial discovery process. These records recently became available for review after they were unsealed by the court following the out-of-court settlement of the lawsuit.

Mr. Martin said representatives of HL&P and NRC will meet shortly in the Arlington regional office to discuss the plan that will be followed in the records review. He pointed out that, although some NRC employees gave evidence in pre-trial depositions and some hCC records may have been introduced, NRC was not a party in the suit and thus was not privy to all the documents.

HL&P and three co-owners hold a construction permit from the NRC to build the South Texas Nuclear Project and have applied for an operating license. Other project owners are City Public Service of San Antonio, Central Power & Light Company, and the City of Austin. Brown & Root is the former project architect-engineer and constructor.
