Dear Mr. Randolph:

' The NRC staff has reviewed and evaluated the information provided by Union Electric Company i in its letter dated September 9,1997, related to relief from ASME Boiler and Pressure Vessel -

! Code,Section XI, Article IWA-7000. In the letter, approval was requested to use ASME Boiler

and Pressure Vessel Code Cat,e N-508-1 as an attemative. The staff has completed its review -

of the proposed relief request. The basis for the staffs conclusion is contained in the enclosed L  : safety evaluation.' For the proposed relief request, the staff has authorized the attemative proposed pursuant to 10 CFR 50.55a(a)(3)(ii), in that compliance with the specified requirement l would result in hardship or unusual difficulty without a compensating increase in the level of  !

. quality and safety. '
